1. GENERAL CONDITIONS OF SALE

These General Conditions of Sale (hereinafter “General Conditions”) are drawn up in compliance with the legislative provisions of the Civil Code, Legislative Decree no. 70 of 04.09.2003 regarding information society services and electronic commerce and Legislative Decree no. 206 of 06.09.2005 (so-called Consumer Code), and, in particular, in Chapter I of title III of part III (articles 45 to 67), and regulate the offer and sale of products through the website www.hinnominate.com (hereinafter the Site).

The HINNOMINATE® brand products marketed on the Site (hereinafter the Products, also in the singular declination) are sold by Dream Project S.p.A., with headquarters in Via Forcella, 3 – 20144 Milan (MI), C.C.I.A.A. of Milan Monza Brianza Lodi at no. REA 2125635 of the Company Register, C.F. VAT no. 06971910721, owner of the Site.

2. INTELLECTUAL PROPERTY, SOFTWARE AND CONTENT

The contents of the Site, such as, by way of example, the works, images, photographs, dialogues, music, sounds and videos, documents, drawings, figures, logos and any other material, in any format, published on the Site, including the menus, web pages, graphics, colors, schemes, tools, characters and design of the website, diagrams, layouts, methods, processes, functions and software that are part of the Site, are protected by law copyright and any other intellectual property rights. Reproduction of the Site and its contents, in whole or in part, in any form, is prohibited without the express written consent of the Manager or other holders of the relevant rights.

Regarding the use of the Site, you are only authorized to view the website and its contents. It is also authorized to carry out all those other temporary acts of reproduction, without any economic significance of their own, which are considered transitory or accessory, an integral and essential part of the very visualization of the Site and its contents and all other navigation operations on the website which are carried out only for legitimate use of the Site and its contents.

However, you are not authorized to carry out any reproduction, on any medium, of all or part of the Site and its contents. Any act of reproduction must be, from time to time, authorized by the Manager or, if necessary, by the authors of the individual works contained in the website or by the owners of the exploitation rights. Such reproduction operations must in any case be carried out for lawful purposes and in compliance with the copyright and other intellectual property rights of the Manager and the authors of the individual works contained on the website. The authors of individual works published on the Site have, at any time, the right to claim authorship of their works and to oppose any deformation, mutilation or other modification of the works themselves, including any act of damage caused to the works, which is prejudicial to their honor or reputation. You undertake to respect the copyright of the artists who have chosen to publish their works on the Site or who have collaborated with the Site in the creation of new expressive and artistic forms intended to be published, even not exclusively on the website, or, again, which form an integral part of it. Furthermore, you are not, under any circumstances, authorized to use, in any way or form, the contents of the website and every single work protected by copyright and any other intellectual property right. By way of example, it may not alter or, in any other way, modify the contents and protected works without the consent of the Manager and, where necessary, of the individual authors of the works published on the Site, or of the owners of the exploitation rights.

2.1 Acceptance of the general conditions of sale and conclusion of the contract

  1. The contract stipulated between Dream Project S.p.A. (hereinafter "Dream Project") and the Customer (i.e. the individual, natural person, who makes the purchase on the Site, not relating to his commercial, entrepreneurial or professional activity) must be considered concluded with the acceptance, even if only partial, of the order by Dream Project. In the event of non-acceptance of the order, Dream Project will in any case promptly notify the Customer.
  2. By placing an order in the various ways provided, according to the order form on the Site (hereinafter the "Order"), the Customer declares to have read all the information provided to him during the purchase procedure and to fully accept these general conditions (hereinafter the "Conditions").
  3. These Conditions may be printed or saved on a durable medium, in compliance with the provisions of the art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
  4. The products offered for sale by Dream Project are only those present on the Site at the time the Order is placed, as described in the relevant information sheets.
  5. In any case, it is understood that the images accompanying the description of a product are for informational purposes only and may not be perfectly representative of its characteristics but may differ, for example. by color and size (also based on the browser and monitor used to access the Site and view the images).
  6. To place an Order, the Customer must complete the relevant form on the Site in its entirety and send it after having carefully read the Conditions, as well as the characteristics of the product and/or products he intends to purchase. The Customer must also request Dream Project, where desired, to issue a tax invoice relating to the purchase, pursuant to art. 22 Presidential Decree n. 633/1972.
  7. The correct receipt of the Order is confirmed by Dream Project by means of a response via e-mail, sent to the e-mail address communicated by the Customer. This confirmation message will summarize the purchase conditions, as required by applicable law, as well as the data entered in the Order by the Customer, so that the Customer can verify the same and possibly communicate the necessary corrections of incorrect data without delay.

3. PRICES AND PAYMENT METHODS

  1. The prices indicated on the site are to be considered inclusive of taxes and VAT. Any shipping costs or payment costs are in any case communicated in advance to the Customer through the site or these Conditions.
  2. The following payment methods are available:
    1. PayPal
      For payment, the customer can use the Paypal circuit according to its specific methods.
    2. Credit or debit card
      In cases of purchase of goods with credit card payment method, the transaction can take place through the secure Paypal server or another secure server chosen by Dream Project.

      In no case and at no stage of the payment will Dream Project be able to know the information relating to the Customer's credit card, transmitted via a protected connection directly to the website of the banking institution that manages the transaction. No Dream Project computer archive will retain such data and therefore in no case Dream Project can be held responsible for any fraudulent or improper use of credit cards by third parties at the time of payment.
    3. Afterpay (only for Italy)
      Payment in installments is possible through the Afterpay provider ("If you buy with Afterpay you will receive your order immediately and pay in 3 installments. You acknowledge that the installments will be transferred to Incremento SPV S.r.l., to related parties and their transferees, and that you authorize this transfer"). Minimum order Euro 5, maximum order Euro 1,500

4. RIGHT OF WITHDRAWAL

  1. Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to provide reasons and without any penalty, within 14 (fourteen) days from the date of receipt of the products.
  2. To exercise the right of withdrawal referred to in the previous article 4.1, the Customer must use the appropriate form present in the package received and send the package to a Post Office or PuntoPoste.
  3. In case of withdrawal, the Customer must send a return authorization request via email to customercare@hinnominate.com or via WhatsApp chat at 353 37 05 737, indicating the order number. Once the authorization and the prepaid label have been received, it will be possible to proceed with the free return of the products by sending them to Dream Project S.p.A., Magazzino 61, Via Callano, 161/163 Complesso Incà, 76121 Barletta (BT).

Each item purchased comes complete with a special security seal. Once the seal has been removed, the item is no longer considered suitable for return: only items with the seal still intact will be accepted.

The goods must be returned intact, without removing the guarantee seal, complete with all its parts and in the original packaging (envelopes and packages), kept and possibly used for the time strictly necessary to establish and verify their nature, characteristics and size, according to normal diligence, without there being any signs of wear or dirt. It is possible to request a return for an exchange of size and/or color only. It is not possible to request a replacement with different products. In the event that the exchange order requested does not meet expectations, the customer may exercise the right of withdrawal and make a second exchange at his own expense. Exchange processing time can vary from 7 to 10 business days.

The right of withdrawal may apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the purchased product (e.g. accessories, complements, etc...). In the event of damage to the goods during transport, the Customer will be able to promptly file a complaint with the courier and obtain a refund. Dream Project will not be liable in any way for damage, theft or loss occurring during or in any case in connection with the return shipment.

It is not possible to return an item purchased online in store.

  1. Dream Project will refund the Customer the entire amount already paid, net of any additional shipping costs pursuant to art. 56, paragraph 2, of the Legislative Decree. 21/14), within 30 (thirty) days from the date of receipt of the item, through a cancellation procedure of the debited amount, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. The Customer will not bear any costs as a consequence of said refund, except in the event that the Customer has not already made a return more than once (generic, change of size and/or colour); in this case the Customer will bear the return shipping costs.

    Dream Project may suspend the refund until receipt of the returned product or until the Customer demonstrates that he has correctly sent the product back.
  2. In any case, the Customer will lose the right of withdrawal in cases where Dream Project ascertains that: the returned product and/or its accessories, and/or its packaging are not intact; the product is missing its external packaging and/or the original internal packaging; the product is missing integral elements and/or accessories (e.g. closures, laces, buckles, etc.).

    In the event of forfeiture of the right of withdrawal, Dream Project will return the purchased product to the sender, charging the shipping costs and, if already refunded, the price of the product.
  3. For all EU orders the first return is free; the customer must return the goods within 14 (fourteen) days from the date of receipt of the products. Only the first return and/or size/color exchange is free, as specified in the previous points.

    For all non-EU orders, the goods can be sent back with costs borne by the end customer by choosing the courier and preferred shipping method. The customer must return the goods within 14 days from the date of receipt of the products. In the case of returns coming from non-EU territories, any duties and charges relating to the customs clearance procedure will be deducted from the total refund amount. Size/color changes are not possible.

5. GUARANTEES

  1. All products sold by Dream Project are covered by a 24 (twenty-four) month warranty for defects of conformity, pursuant to Title III of Legislative Decree. 206/2005. To benefit from warranty assistance, the Customer must keep the invoice, or the payment receipt, together with the transport document.
  2. The warranty for defects of conformity will apply provided that the relevant product has been used correctly, in compliance with its intended use and as provided in the use and washing instructions present in and/or with the product.
  3. In the event that, for any reason, Dream Project is unable to return a product under warranty to the Customer (restored or replaced), or if the repair or replacement is excessively expensive, also due to the value of the product, Dream Project may proceed with an appropriate reduction in the price paid, or with the refund of the entire amount paid with termination of the contract.
  4. In cases where the application of the guarantees requires the return of the product, the same must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).

7. PRIVACY

The personal data collected when placing the Order will be processed by Dream Project for the sole purpose of satisfying the express requests of the Customer, in compliance with European Regulation 679/2016 and the privacy information on the site. Any further processing will be carried out only with the express consent of the Customer.

8. APPLICABLE LAW

  1. The sales contract referred to in these Conditions and its execution is governed by Italian law, with the non-application of conflict rules and the United Nations Convention for the International Sale of Goods. The Court of the municipality of residence of the Customer will be competent to resolve the related disputes.
  2. We would like to inform you that the European Commission provides a platform for the alternative extra-judicial resolution of disputes, including cross-border, accessible on the site http://ec.europa.eu/odr.
